Terms of Service

These terms govern your use of kuwakuwa ("the Service"), a swimming log provided by kuwakuwa studio ("we"). By using the Service you agree to these terms.
1. What the Service does
kuwakuwa is an iOS app that reads the swimming workouts recorded in the Apple Health app, organises them, lets you build training programs and link them to your records, and lets clubs share training with each other.
We may improve or change the Service, and we will let you know in advance of significant changes.
2. Your account
You can only sign up using Sign in with Apple. You are responsible for your own account and may not transfer or lend it to anyone else.
If you are under 14, you may use the Service only after your guardian has given consent.
You can delete your account at any time from the Profile screen in the app.
3. Subscriptions and payment
Some features are available to Pro subscribers. Pro is an auto-renewing subscription offered on a monthly or annual basis.
- Payment is charged to your Apple App Store account.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. The renewal charge is applied within 24 hours of the period ending.
- You can manage or cancel your subscription in your App Store account settings.
- Where a free trial is offered, it converts to a paid subscription unless cancelled before the trial ends.
- Refunds are handled by Apple under Apple’s refund policy; we cannot process them directly.
If your subscription expires, the records and training programs you have already saved remain intact. Access to Pro-only features may be limited.
4. Content you create
You retain the rights to the content you create — training programs, club posts, comments, and session notes.
When you publish content or share it with a club, you allow us to use that content to the extent needed to operate the Service and display it to other members. We will not use it beyond that.
When you delete your account, content created together with other members is not deleted but is anonymised.
5. Things you may not do
- Impersonate another person or misuse someone else’s personal information or records
- Post content that harasses, demeans, or discriminates against others
- Post material that infringes someone else’s copyright
- Manipulate the Service or access it in bulk by automated means
- Break the law or interfere with the operation of the Service
If we confirm a violation, we may remove the content or restrict access to the Service. You can flag inappropriate content using the reporting feature in the app.
6. Training advice is not medical advice
The analysis and training programs offered by the Service are reference material based on your records. They are not a medical diagnosis and are not medical advice.
If you have a health condition or an injury, consult a physician or another qualified professional before beginning training. You are responsible for judging the intensity and scope of training that suits your own physical condition.
AI-generated analysis and programs can be inaccurate, and we do not warrant their correctness.
7. Accuracy of records
Distance, pace, stroke type, heart rate, and other figures shown in the Service are taken as-is from the Apple Health app and your device. Measurement accuracy depends on the device and how it is worn, and we do not warrant the accuracy of the underlying measurements.
8. Interruptions to the Service
We may suspend the Service temporarily for maintenance, technical failures, or events beyond our control. Planned maintenance will be announced in advance.
If we discontinue the Service, we will give at least 30 days’ notice and explain how you can review and keep your records.
9. Limitation of liability
We are liable for damage caused by our intent or negligence, to the extent provided by applicable law.
We are not liable for damage arising from matters outside our control, such as your device settings, your network conditions, or measurement errors in the Apple Health app.
10. Changes to these terms
We may change these terms where necessary. We will announce changes in the Service or on this page at least seven days before they take effect, and at least 30 days in advance where the change is unfavourable to you.
If you do not agree to the revised terms, you may delete your account and stop using the Service.
11. Governing law
These terms are governed by the laws of the Republic of Korea. If a dispute arises, we and you will first try in good faith to resolve it by discussion; failing that, it will be handled under the procedures set out by applicable law.
